A prenuptial agreement, often called a prenup, is a legal document that couples sign before marriage to outline the division of assets, debts, and other financial matters in the event of divorce or death.
A prenuptial agreement is valid and enforceable in Georgia when signed voluntarily with full financial disclosure and remains fair both at signing and enforcement. Courts reject agreements involving fraud, duress, or unconscionable terms that leave one spouse destitute.
In California, a prenuptial agreement can include property division, debt allocation, spousal support terms, and business or inheritance protections. However, it cannot include illegal terms, promote divorce, or set child custody/support, which courts decide based on the child's best interests, and grossly unfair terms may be invalidated.
However, it cannot include anything illegal, encourage divorce, or decide child custody or support—those must follow Georgia law and be in the child’s best interest. Unfair or one-sided terms may also be thrown out by the court.
In California, a prenuptial agreement can be challenged for lack of voluntary consent (duress, fraud, or undue influence), failure to provide full financial disclosures, unconscionability at signing or enforcement, or improper execution under state law.
To ensure a prenup is enforceable in California, couples should sign it voluntarily at least seven days after full financial disclosures, have it in writing with independent legal counsel for each, and avoid unconscionable terms.
