A prenuptial agreement, often called a prenup, is a legal document that couples sign before marriage to outline the division of assets, debts, and other financial matters in the event of divorce or death.

In Georgia, a prenuptial agreement is valid if it’s in writing, signed voluntarily by both parties, and includes full disclosure of assets. It must be fair at the time of signing and enforcement, and not obtained through fraud or duress. While not required, having separate attorneys helps ensure both parties understand the terms. Agreements can’t include anything illegal or against public policy, like waiving child support.

In Georgia, a prenuptial agreement can include terms about dividing property, handling debts, and spousal support in case of divorce. It can also cover inheritance rights and ownership of assets or businesses.

However, it cannot include anything illegal, encourage divorce, or decide child custody or support—those must follow Georgia law and be in the child’s best interest. Unfair or one-sided terms may also be thrown out by the court.

In Georgia, a prenuptial agreement can be challenged if it was signed under pressure, without full financial disclosure, or based on fraud or misrepresentation. It can also be invalidated if the terms were unfair when signed or have become unfair over time. If enforcing the agreement would lead to an unjust outcome, the court may decide not to uphold it.
